DESCRIPTION OF AN ADMINISTRATIVE SERVICE PROVIDED BY THE NATIONAL ENERGY REGULATORY COUNCIL

 

ISSUING, AMENDING (ADDING AND/OR UPDATING DETAILS), SUSPENDING, LIFTING THE SUSPENSION, AND INVALIDATING CERTIFICATES OF THE RIGHT OF INSTALLATION AND OPERATION OF ENERGY INSTALLATIONS

A form of application for issuing (amending) the certificate is approved by resolution of the National Energy Regulatory Council (the 'Council') No O3E-279 of 25 July 2019 'On the approval of the Procedure for the Issue of Certificates of the Right of Installation and Operation of Energy Installations'.

4.Length of service provisionThe Council takes a decision on the issue of the certificate or provides a reasoned refusal in writing no later than within 30 (thirty) calendar days after receipt of the application and all requisite documents properly drawn up.
5.Service price

In accordance with the List of Specific Amounts of Fees Payable to the State approved by Resolution of the Government of the Republic of Lithuania No 1458 of 15 December 2000 'On the approval of the List of Specific Amounts of Fees Payable to the State and the Rules for Payment and Refunding of the Fees', the following fees are to be paid:

Issue of the Certificate of the Right of Installation and Operation of Energy Installations – EUR 86;

Amendment to the Certificate of the Right of Installation and Operation of Energy Installations – EUR 70.

6.Terms of payment for the service (including payment methods for foreigners)The fee is paid to a bank account of the State Tax Inspectorate under the Ministry of Finance for the collection of state budget revenues, payment reference 5782.
7.Description of the service provision process

The Certificate of the Right of Installation and/or Operation of Energy Installations certifies the economic operator's proper preparedness to install and/or operate energy installations.

Types of the certificates:

1. Installation of electrical installations;

2. Installation of natural gas installations;

3. Operation of electrical installations;

4. Operation of heat installations and turbines;

5. Operation of natural gas installations;

6. Operation of liquefied gas oil installations;

7. Operation of oil and petroleum product installations.

An economic operator must file an application in set form, accompanied by requisite documents, to the Council in order to obtain the certificate, amend the certificate (add details to and/or update the certificate), suspend validity of the certificate, lift the suspension of the certificate, or invalidate the certificate.

An application with the documents can be filed to the Council either by post and/or online through E-Government Gateway, a portal for administrative and public e-services.

The documents can be submitted and the application can be filed by a representative of the applicant and/or the economic operator who has the right to represent the latter according to the law, having produced a power of attorney and a personal ID document or, where the application is sent by post – a copy thereof.

Where the documents are submitted to the Council through the E-Government Gateway, identity of the applicant is established according to information in the Register of Residents and/or Register of Legal Entities of the Republic of Lithuania.

Documents of the applicant and/or a legal entity that is a legal person can be submitted through the E-Government Gateway also by a representative of the applicant – legal entity for whom a power of attorney has been issued by the head of the legal entity through the E-Government Gateway.

Where the documents are submitted to the Council by means other than through the E-Government Gateway, the legal entity must file an application in set form.

Applications sent by email must be signed with a secure electronic signature generated by means of secure signature generation facilities and certified by a valid qualified certificate, or generated by electronic means that ensure integrity of the text and the impossibility of changing it.

The application must be in the official language or must be accompanied by a translation into the official language certified according to a procedure prescribed by the law, except in cases where a foreign institution or an international organisation is applying to the Council under international legal acts.

The information provided by an economic entity will be checked by a specialist of a territorial division of the Council, after which the economic entity will be assessed based on this information and/or a spot check will be conducted. An opinion on the entity's preparedness to install and/or operate an energy installation, in set form, will be issued within 15 (fifteen) calendar days. A decision on the issue of/amendment to the certificate of the right to instal and/or operate an energy installation, with a mandatory annex thereto, will be drafted. The certificate with the mandatory annex, generated on the basis of the decision, is signed by the Chair of the Council.

The certificate is issued for a period of 5 (five) years.

In accordance with Resolution of the Government of the Republic of Lithuania No 937 of 18 July 2012 'On approval of the Description of Grounds for Licensing', certificates are issued, amended (by adding details to the certificate and/or updating the certificate), their validity is suspended and suspension is lifted, and certificates are invalidated using a state information system which has been developed and administered by the Centre of Registers and which is designed for the centralised management of  information on licenses issued to economic operators. The certificate must contain the information referred to in p. 40 of the Certification Rules.

8.Information and documents to be submitted

An application for the certificate filed by an economic operator in set form must contain the following details:

1. Name, legal form, registered entity number, registered office address, total number of employees, telephone and fax numbers, email address – for a legal entity, or: first name and surname, personal ID No (if any), date of birth, declared place of residence, telephone No and email – for a natural person;

2. Type of the certificate applied for;

3. Where the applicant is a citizen of another Member State or another individual that exercises the freedom of movement under the EU laws, and seeks the issuance of the certificate, the applicant must submit a document evidencing the said right; and

4. The method by which the applicant wishes to be informed about decisions taken.

The applicant must append the following documents to their

application:

1. A list of works of installation and/or operation of energy installations planned by the economic operator;

2. A list of main technological, technical and regulatory documents available, specifying technical data on the energy installations, setting forth installation and/or operation procedures etc.;

3. A list of available main technical and process equipment and devices that are necessary for the works listed in the application; a list of personal protection equipment required for safe work;

4. A statement on certification of works superintendents, engineers and workers engaged in the installation and operation of the energy installations, and energy specialists for the operation and/or installation of energy installations;

5. Information on agreements on lease or loan-for-use of installations and facilities, specifying agreement number and details of the customer and lessor;

6. A document proving that the relevant fee has been paid for the checking of the economic operator's preparedness to instal and/or operate energy installations in a qualified manner, in accordance with the Republic of Lithuania Law on Fees and the List of Specific Amounts of Fees Payable to the State approved by Resolution of the Government of the Republic of Lithuania No 1458 of 15 December 2000 'On the approval of the List of Specific Amounts of Fees Payable to the State and the Rules for Payment and Refunding of the Fees;

7. List of works completed during the past two years (in cases where the certificate is applied for by a certificate holder);

8. Information on the current certificate: type, number and date of issue (only when the certificate is issued to a current economic operator, or in the case of amendments to the certificate)

9. A copy of a professional civil liability insurance policy specified in Article 221 of the Law on Energy. This requirement applies to only to persons applying for the certificate of the right to instal energy installations.

10.Procedure for appealing against actions/omissions of the service providerAn economic entity that disagrees with the Council's decision may file an appeal to the Commission on Administrative Disputes or to Administrative Court, within 30 calendar days after the adoption of the decision, according to a procedure prescribed by the law.
