The Certificate of the Right of Installation and/or Operation of Energy Installations certifies the economic operator's proper preparedness to install and/or operate energy installations. Types of the certificates: 1. Installation of electrical installations; 2. Installation of natural gas installations; 3. Operation of electrical installations; 4. Operation of heat installations and turbines; 5. Operation of natural gas installations; 6. Operation of liquefied gas oil installations; 7. Operation of oil and petroleum product installations. An economic operator must file an application in set form, accompanied by requisite documents, to the Council in order to obtain the certificate, amend the certificate (add details to and/or update the certificate), suspend validity of the certificate, lift the suspension of the certificate, or invalidate the certificate. An application with the documents can be filed to the Council either by post and/or online through E-Government Gateway, a portal for administrative and public e-services. The documents can be submitted and the application can be filed by a representative of the applicant and/or the economic operator who has the right to represent the latter according to the law, having produced a power of attorney and a personal ID document or, where the application is sent by post – a copy thereof. Where the documents are submitted to the Council through the E-Government Gateway, identity of the applicant is established according to information in the Register of Residents and/or Register of Legal Entities of the Republic of Lithuania. Documents of the applicant and/or a legal entity that is a legal person can be submitted through the E-Government Gateway also by a representative of the applicant – legal entity for whom a power of attorney has been issued by the head of the legal entity through the E-Government Gateway. Where the documents are submitted to the Council by means other than through the E-Government Gateway, the legal entity must file an application in set form. Applications sent by email must be signed with a secure electronic signature generated by means of secure signature generation facilities and certified by a valid qualified certificate, or generated by electronic means that ensure integrity of the text and the impossibility of changing it. The application must be in the official language or must be accompanied by a translation into the official language certified according to a procedure prescribed by the law, except in cases where a foreign institution or an international organisation is applying to the Council under international legal acts. The information provided by an economic entity will be checked by a specialist of a territorial division of the Council, after which the economic entity will be assessed based on this information and/or a spot check will be conducted. An opinion on the entity's preparedness to install and/or operate an energy installation, in set form, will be issued within 15 (fifteen) calendar days. A decision on the issue of/amendment to the certificate of the right to instal and/or operate an energy installation, with a mandatory annex thereto, will be drafted. The certificate with the mandatory annex, generated on the basis of the decision, is signed by the Chair of the Council. The certificate is issued for a period of 5 (five) years. In accordance with Resolution of the Government of the Republic of Lithuania No 937 of 18 July 2012 'On approval of the Description of Grounds for Licensing', certificates are issued, amended (by adding details to the certificate and/or updating the certificate), their validity is suspended and suspension is lifted, and certificates are invalidated using a state information system which has been developed and administered by the Centre of Registers and which is designed for the centralised management of information on licenses issued to economic operators. The certificate must contain the information referred to in p. 40 of the Certification Rules. |
