DESCRIPTION OF ADMINISTRATIVE SERVICE PROVISION

OF THE NATIONAL ENERGY REGULATORY COUNCIL

 

ISSUING OF CERTIFICATES OF INSTALLATION AND OPERATION ACTIVITY OF ENERGY EQUIPMENT

The application form for issuing (changing) the certificate was approved by the State Energy Regulatory Council (hereinafter – the Council) Resolution No  "On Approval of the Procedure for Issuing of Certificates of Installation and Operation Activity of Energy Equipment" of 25 July 2019.

4.Duration of the service provisionThe Council shall, no later than within 30 calendar days from the date of the receipt of the application for a certificate and all duly prepared documents, either decide to issue a certificate, or make a grounded written refusal to issue a certificate.
5.Price of the service

According to the list of specific state fee rates approved by the Resolution No 1458 of the Government of the Republic of Lithuania of 15 December 2000 "On the Approval of the Specific State Fee Rates and the Rules on Payment and Refund", the fixed state fee rates are paid:

The issuance of a certificate of installation or operation of energy equipment – EUR 83.

The changing of a certificate of installation or operation of energy equipment – EUR 46.

6. Methods and procedures of payment for the service (also including the payment possibility for foreigners)The state fee is paid to the budget revenue collection accounts of the State Tax Inspectorate under the Ministry of Finance; payment code is 5782.
7.Description of the service provision process

The certificate for the installation and/or operation of energy equipment shall confirm the economic entity's proper preparation for the installation and/or operation of energy equipment.

The certificates are of the following types:

1. Installation of electrical equipment;

2. Installation of natural gas equipment;

3. Operation of electrical equipment;

4. Operation of heat equipment and turbines;

5. Operation of natural gas equipment;

6. Operation of liquefied petroleum gas equipment;

7. Operation of oil and petroleum products.

An entity seeking to obtain a certificate, to change a certificate (to complement and/or clarify the data recorded in the certificate), to suspend the validity of the certificate, shall submit an application form, and relevant documents to the Council.

The application with the documents may be submitted to the Council by post and/or via the Internet via the Electronic Government Gateway portal for administrative and public electronic services.

Submission of documents and completion of the application may be done by a representative of the applicant and/or the economic entity, who has the right to represent him/her in accordance with the procedure established by law, by submitting a power of attorney and identity document or a copy thereof.

When documents are submitted to the Council through the Electronic Services Portal, his/her identity is confirmed according to the data of the Center of Registers of residents of the Republic of Lithuania and/or according to the data of the Register of Legal Persons.

The documents of the applicant and/or economic entity–legal person through the Electronic Services Portal might be also submitted by a represantative of the applicant and/or economic entity–legal person, who is authorized by the manger of the legal person through the Electronic Services Portal.

Where documents are submitted to the Council through a portal other than the Electronic Services Portal, the entity must submit an application in the established form.

Applications sent by e-mail, must be signed by a secure electronic signature created by a secure-signature-creation device and approved by the valid qualified certificate, or formed by electronic means, which allows to ensure the coherence and unchangeability of the text.

The application must be made out in the official language or to be translated in the official language according to the procedure established by law, except cases when a foreign institution or international oganization applies in writing to the Council in accordance with international law.

The specialist of the Division of the Territorial Council shall verify the entity's reported data and assess the entity in accordance with the submitted documents and/or performs the assessment on-the-spot, and within 15 calendar days shall draw up the conclusion in the established form on the entity's preparation to install and/or operate the energy equipment. On the basis of the conclusion, the decision is prepared in the established form on the issuing or changing of the certificate and its mandatory annex to install and/or operate the energy equipment. The certificate and its mandatory annex formed on the basis of the decision shall be signed by the Chairman of the Council.

The certificates shall be issued for a period of five years.

Issuance and modification of certificates (supplementation and/or revision of data entered in the certificate), the suspension of the validity of certificates, the revocation of the suspension shall be performed pursuant to the Resolution No 937 of the Government of the Republic of Lithuania "On Approval of the Description of Licensing Basics"; the validity shall be revoked by using the system created and administrated by the State Enterprise Center of Registers, established for the management of data  and information on the licences issued to the economic entities on-the-spot. The certificate shall contain the information referred to in point 40 of the Rules of Certification.

8.Information and documents to be provided by the person

An entity wishing to obtain a certificate shall submit the application to the Council in the established form, which must include:

1. Applicant's (legal person's) name, legal form, code, registration address, total number of the employees of the legal person, telephone and fax numbers, e-mail address or applicant's (natural person's) name, personal identification code (if available), exact date of birth, declared place of residence, telephone number and e-mail address;

2. Type of the certificate to be obtained;

3. If the applicant is a citizen of another Member State or another natural person who exercises the rights of free movement conferred upon him/her by the law of the European Union within the Member States,  and seeks to obtain a certificate, must submit the document confirming this right;

4. The manner in which the applicant wishes to obtain information on the decisions taken.

The applicant shall submit the following documents in addition to the mentioned application:

1. A list of works of the installation and/or operation of the energy equipment that the economic entity wishes to perform;

2. A list of the main technological, regulatory ans technical documents specifying the technical data of the installed and/or operated equipment, the procedures of the installation and/or operation of the facility, and others, necessary for the implementation of the works indicated in the application;

3. A list of the main technical, technological equipment and devices necessary for the implementation of the works indicated in the application, as well as the personal protective equipment needed to ensure safe operation;

4. The statement on the certification of operation supervisors and energy sector employees of categories in working and engineering installation and operation of energy equipment in order to operate and/or install energy equipment;

5. Information on the contracts of lease or loan of the equipment and devices to be leased, including the contract number, the details of the customer and the lessor;

6. The document confirming that for the check of the entity whether he is prepared to competently perform the installation and/or operation of the energy equipment, is paid the state fee of specified amount determined by the Government, under the procedure established by the Law on Charges of the Republic of Lithuania and by the Decision of the Government of the Republic of Lithuania No 1458 "On Approval on the Specific Amounts of State Charges and the rules of these charges payment and return" of 15 December 2000;

7. List of works carried out in the last two years (where the certificate holder requests the certificate);

8. Information on the type, number and the issue date of the held certificate (to be provided only in case of issuing the certificate to the economic entity in operation or in case of the certificate replacement);

9. A copy of the certificate of professional indemnity insurance referred to in Article 221 of the Law on Energy. This requirement applies only to persons seeking certificates for the installation of energy equipment.

10. Appeal procedure against actions (inactions) of the service providerAn entity shall have the right to appeal to the Administrative Disputes Commission or to the Administrative Court within 30 calendar days of the decision, in accordance with the law.

3. A list of energy equipment operation works that may be carried out by a natural person, approved by the Order No 1-305 of the Minister of Energy of the Republic of Lithuania "On the approval of the list of energy equipment operation works that may be carried out by a natural person" of 29 October 2010";

4. Description of the procedure for issuing certificates for the installation and operation of energy equipment, approved by the Resolution No O3E-279 of the State Energy Regulatory Council  "On Approval of the Procedure for Issuing of Certificates of Installation and Operation Activity of Energy Equipment" of 25 July 2019.
